Gamesys fully supports government, regulator and player concerns that gambling should be conducted fairly and openly, children and the vulnerable should be protected from being harmed or exploited, and gambling should be kept free of crime. The Gamesys Group policy is to offer its cash games to players only in countries where online gambling is legal. Since trading began (and up to March 2011), over 90% of our ‘cash’ players are from the UK. The Gamesys Group operates its gambling services under Gibraltarian and Maltese licenses. The UK Gambling Commission has also granted Gamesys Group a remote gambling software operator licence.
Gamesys believes strongly in the need for effective regulation in the egaming sector and the need for all operators, whether publicly or privately owned, to offer responsible gaming through strong Know Your Customer / Age Identification controls and a variety of player imposed deposit limits, cool off and self-exclusion controls. All UK Gamesys gaming sites are GamCare certified. GamCare provides support, information and advice to anyone suffering through a gambling problem. Only those companies operating to the highest standards in player protection and social responsibility are awarded this certification.
Gamesys also believes strongly in the need for effective measures to protect both players and the industry from criminal exploitation. Whilst Gamesys is not privy to other operator trading activity, analysis of its own trading (since accepting bets in early 2002) confirms that attempted card fraud is low and successful card fraud extremely low. Chargeback rates reclaimed by banks on behalf of customers are to date just 0.2% of all successful deposits, and a minority of those chargebacks relate to fraudulent use of player’s cards / identities by third parties. Gamesys' use of third party identity checking and in house transactional activity reviews significantly reduces the risk of money laundering.
Gamesys, alongside other publicly and privately owned operators, donates voluntarily a percentage of its revenues (gross win) to appropriate charitable organisations (in countries we offer our services). These organisations support problem gamblers and work to reduce the risks of addiction. Gamesys currently donates 0.15% of its revenue annually to such organisations.
In certain countries, such as the USA, the provision of online gambling products by state monopolies and private operators, whether based in the USA or operating from abroad, is illegal. In such countries, card deposits (and deposits by other financial transactions) are blocked to ensure compliance with such laws.
In the European Union, some member state governments try to restrict their citizens to playing at state owned, monopoly, gambling operators. Several governments claim such bans are the only way to offer responsible gaming, limit addiction and avoid criminal activity – particularly fraud and money laundering. An increasing number of European country governments are recognising that effective regulation of operators, rather than public ownership of operators, is key to ensuring a successful industry with strong protections for players.
Whilst some such countries are introducing new legislation, some European countries refuse to do so, or are choosing to issue licences covering certain products, which may lead to continued protection for state operators in certain product areas. Gamesys, alongside other European private operators expect the European Commission to continue to progress its proceedings against several Member States that are deemed to be in breach of European Community law, specifically Article 49 of the Treaty of Rome: the freedom to provide and receive services within the EU without discrimination on grounds of nationality.
Whilst the Gamesys Group currently limits itself to marketing games in the UK and Spain, the Group’s intention, over time, is to offer great entertainment and games to players across the EU. Gamesys believes that in countries where EU Member States allow national operators to provide and market gambling services, the playing field should be level, so abiding by the principles of the Treaty of Rome, and allowing EU-regulated operators to offer services in competition with national providers. In Member States where all entities are prevented from offering gambling services to players, as stated above, Gamesys’ policy is to abide by such laws.
